Guest Lecture for Future Lawyers: Distinguishing Stalking and Kidnapping
A guest lecture was held for students of the 6B042 “Law” educational program on the topic: “Stalking — Article 115-1 of the Criminal Code of the Republic of Kazakhstan and Kidnapping — Article 125 of the Criminal Code of the Republic of Kazakhstan: Issues of Qualification, Evidence, and Differentiation of Offenses,” devoted to crimes against the person.
The speakers were the Head of the Domestic Violence Prevention Unit of the Alatau District Police Department, Police Major Abdimomynov Zh.B., and a well-known human rights defender, member of the Board of Trustees of the Public Social Fund “Kazakhstan Khalkyna,” and head of the Republican Public Association “Public Control and Monitoring,” S.Zh. Taukeleva.
During the meeting, the problematic aspects of the legal qualification of these crimes, the criteria for their differentiation, and the specifics of evidence collection were discussed in detail.
The speakers paid special attention to the issue of domestic violence, which often serves as a precondition for conflicts escalating into more serious offenses: from quarrel to crime, stalking as a form of domestic violence, and protection of victims’ rights.
Thanks to the participation of a human rights advocate, the lecture gained particular value, as it allowed the issue to be examined not only from a legal perspective but also through the lens of protecting victims’ rights and preventing domestic violence. The students learned about modern approaches to investigating stalking cases and the specifics of law enforcement work in kidnapping cases, gaining invaluable experience from an active police officer and a public figure.
